OVERVIEW
Due to rapid growth and the need for supporting infrastructure, the City of Conway has initiated impact fees. New businesses and residences add traffic to the existing street network. New residences add to the need for more parks, open green space, and an improved road network.
These fees are based on a recommended fee structure developed by Duncan Associates. In April 2003, Duncan Associates presented their final Road and Park Impact Fee Study to the Conway City Council. Impact Fees were added to the Conway Subdivision Ordinance by Ordinance O-03-98 on July 29, 2003. These fees became effective on September 1, 2003.
The fees collected are for two purposes, the building of new roads and parks. These fees cannot be used for maintenance of existing parks and roads.
Commercial development does not pay the park impact fee, only for roads. Commercial impact fees are based on the business use. Uses causing higher traffic impacts pay higher impact fees. Remodeling of a business is subject to impact fees if the new business use is one of higher traffic generation.
New residential development pays both the park and road impact fee. Residential impact fees are based on the square footage of the house. Any additional remodeling to a residence is exempt from new impact fees as long as no new dwelling units are created, such as a single-family dwelling becoming a duplex.
Much of downtown Conway and the Industrial area of Conway are exempt from impact fees as an incentive for economic growth. Please see the maps below for details.
Credits for road and park impact fees can only be given for improvements to major roadways and parks serving the entire community. No credit is given for right of way dedication since no road right of way costs were included in the calculation of road impact fees.
